These Terms of Service (“Terms”) govern your access to and use of the CptBoost website (cptboost.com) and related services (collectively, the “Service”), operated by CptBoost (“CptBoost”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Independent Tool Disclaimer

CptBoost is an independent, third-party web analytics tool for CapCut creators. CptBoost is not affiliated with, endorsed by, sponsored by, or otherwise connected to CapCut, ByteDance Ltd., or any of their affiliates or subsidiaries. All references to CapCut are for identification and informational purposes only. All CapCut trademarks, logos, and content are the property of their respective owners.

Description of the Service

CptBoost provides tools to track and analyze publicly available CapCut templates, including template discovery, creator leaderboards, trend tracking, an audio hub, and a download helper. The Service surfaces publicly available metadata and analytical estimates. We may add, modify, or remove features at any time without notice.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your country, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that you will comply with these Terms and all applicable laws.

Acceptable Use and Prohibited Conduct

You agree not to:

• Use the Service for any unlawful, infringing, or fraudulent purpose.
• Attempt to gain unauthorized access to the Service, its servers, or related systems.
• Interfere with, disrupt, or overload the Service, including through excessive automated requests, scraping beyond permitted use, denial-of-service attacks, or the introduction of malware.
• Circumvent, disable, or interfere with security or access-control features.
• Reproduce, resell, or commercially exploit the Service or its content without our prior written permission.
• Use the Service to infringe the intellectual property or privacy rights of others.
• Misrepresent your affiliation with any person or entity, including CptBoost, CapCut, or ByteDance.

Intellectual Property

The Service, including its design, text, graphics, software, and the CptBoost name and logo, is owned by or licensed to CptBoost and is protected by applicable intellectual property laws, including the Norwegian Copyright Act (åndsverkloven). Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from our proprietary content.

Third-party names, trademarks, templates, audio, and other content displayed through the Service, including CapCut-related content, remain the property of their respective owners. CptBoost claims no ownership over such third-party materials and displays them only for informational and analytical purposes.

User Responsibilities

You are responsible for your use of the Service and for ensuring that your activities comply with applicable laws and any third-party terms (including CapCut’s own terms) that may apply to content you access or download. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Third-Party Links and Services

The Service may contain links to, or interoperate with, third-party websites, platforms, and services that we do not control, including advertising provided by Google. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.

Disclaimers of Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any analytics, estimates, metrics, or other information provided will be accurate, complete, or reliable. Virality metrics and performance figures are estimates only. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory Norwegian law.

Limitation of Liability

To the maximum extent permitted by mandatory Norwegian law, CptBoost and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or NOK 100 (one hundred Norwegian kroner), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless CptBoost and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

Changes to the Terms

We may modify these Terms at any time. When we do, we will update the “Last updated” date above. Material changes may be communicated through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions that by their nature should survive, including intellectual property, disclaimers, limitation of liability, and indemnification, will remain in effect.

Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by and construed in accordance with the laws of Norway, without regard to conflict-of-law rules. The parties submit to the exclusive jurisdiction of the Norwegian courts, with Oslo District Court (Oslo tingrett) as the agreed legal venue. Nothing in these Terms limits any rights you may hold under mandatory Norwegian consumer-protection law.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and CptBoost regarding the Service.
